Interpretation and Definitions

Interpretation

Words whose initial letter is capitalized have the meanings defined below. These definitions have the same meaning whether they appear in the singular or the plural.

Definitions

For the purposes of these Terms and Conditions:

Company (referred to as either "the Company", "We", "Us" or "Our") refers to DKY Games UG (haftungsbeschränkt), Klara-Franke-Straße 30, 10557 Berlin, Germany.
Device means any device that can access the Service, such as a computer, a phone or a tablet.
Games means the games we develop and publish, whether played in a browser or installed on a Device.
Platform means a third-party store or service through which a Game is distributed, such as the Apple App Store or Google Play.
Service refers collectively to the Website and the Games.
Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions, which form the entire agreement between You and the Company regarding the use of the Service.
Website refers to DKY Games, accessible from https://www.dkygames.com.
You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

Acceptance of These Terms

These Terms govern the use of the Service and form the agreement between You and the Company. They set out the rights and obligations of all users.

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of them, You may not use the Service.

Your use of the Service is also conditioned on Your acceptance of our Privacy Policy, which describes how we collect and use Your personal data and explains Your rights under the General Data Protection Regulation (GDPR).

Eligibility and Age

The Service is intended for a general audience.

If You are under 18, You may only use the Service with the consent of a parent or legal guardian. Under German law (§§ 104 ff. BGB), a contract entered into by a minor without such consent may be ineffective.

If You are under 16, You may not submit personal data to Us without the consent of a parent or legal guardian.

Where a Game carries an age rating on a Platform, that rating applies in addition to these Terms.

Licence to Use the Games

Subject to Your compliance with these Terms, We grant You a limited, non-exclusive, non-transferable, revocable licence to install and play the Games for Your own personal, non-commercial use.

We do not sell the Games to You; We license them. All rights not expressly granted are reserved.

Purchases and Virtual Items

Some Games may offer paid content or virtual items.

Where a purchase is made through a Platform, the purchase is processed by that Platform under its own terms, and its refund policy applies to that transaction. We do not receive Your payment details.

Virtual items and in-game currency are licensed to You for use within the relevant Game. They have no monetary value, cannot be exchanged for real money or goods, and may be withdrawn if a Game is discontinued.

Right of Withdrawal

If You are a consumer resident in the European Union, You generally have a statutory right to withdraw from a contract for digital content within 14 days, without giving a reason.

This right expires early if You expressly consent to immediate delivery of the digital content and acknowledge that You thereby lose Your right of withdrawal. Purchases made through a Platform are subject to that Platform's implementation of this right.

Acceptable Use

You agree not to:

reverse engineer, decompile or modify the Games, except to the extent this is permitted by mandatory law (§ 69e UrhG);
use cheats, bots, automation or exploits, or otherwise interfere with normal gameplay;
use the Service for any unlawful purpose, or in a way that disrupts it for other users;
attempt to gain unauthorized access to any part of the Service or its underlying systems.

We may suspend or terminate access if You breach this section.

Intellectual Property

The Service and its original content, features, artwork, characters, code and functionality are and will remain the exclusive property of the Company and its licensors, and are protected by copyright and other laws.

Our name, logo and the names of our Games may not be used without our prior written permission.

Availability and Changes to the Service

We aim to keep the Service available, but We do not guarantee that it will be uninterrupted or error-free. We may update, modify, suspend or discontinue any part of the Service, including individual Games, at any time.

Where We discontinue a Game that You have paid for, We will give reasonable notice where practicable.

Links to Other Websites

The Service may contain links to third-party websites or services that We do not own or control.

We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party websites or services. We strongly advise You to read the terms and privacy policies of any third-party site You visit.

Termination

We may suspend or terminate Your access to the Service immediately, without prior notice, if You materially breach these Terms.

Upon termination, Your right to use the Service ceases immediately. Your statutory rights as a consumer remain unaffected.

Warranty

Your statutory warranty rights (Gewährleistung) under German law apply and are not limited by these Terms.

Beyond those statutory rights, the Service is provided on an "as available" basis. We give no guarantee that the Service will meet Your particular requirements or be compatible with every Device.

Limitation of Liability

We are liable without limitation:

for damages arising from injury to life, body or health;
for damages caused intentionally or by gross negligence;
to the extent We have assumed a guarantee; and
under the German Product Liability Act (Produkthaftungsgesetz).

In cases of slight negligence, We are liable only where We breach a material contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place, and on whose observance You may regularly rely. In such cases, our liability is limited to the damage that is foreseeable and typical for this type of contract.

Any further liability is excluded.

Governing Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

If You are a consumer resident in the European Union, this choice of law does not deprive You of the protection of the mandatory provisions of the law of the country in which You are resident.

Dispute Resolution

If You have a concern or dispute about the Service, We ask that You first contact Us so that We can try to resolve it informally.

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be interpreted so as to accomplish its objective as closely as possible under applicable law, and the remaining provisions will continue in full force and effect.

Our failure to enforce a right or provision of these Terms will not be considered a waiver of that right.

Language

These Terms are available in English and German. For users resident in Germany, the German version prevails in the event of any discrepancy. For all other users, the English version prevails.

Changes to These Terms and Conditions

We may modify or replace these Terms at any time. If a change is material, We will make reasonable efforts to give at least 30 days' notice before it takes effect.

By continuing to use the Service after a revision becomes effective, You agree to be bound by the revised Terms. If You do not agree to the new Terms, please stop using the Service.
