We have not appointed a Data Protection Officer, as We are not required to do so under Art. 37 GDPR and § 38 BDSG.
Definitions
- GDPR means Regulation (EU) 2016/679, the General Data Protection Regulation.
- Games means the games We develop and publish, whether played in a browser or installed on a device.
- Personal Data is any information relating to an identified or identifiable natural person.
- Processor means a natural or legal person who processes personal data on our behalf.
- Service refers collectively to the Website and the Games.
- Website refers to DKY Games, accessible from https://www.dkygames.com.
- You means the natural person visiting the Website or playing a Game.
The Website
No Cookies, No Tracking, No Analytics
Our Website does not set cookies. It does not use analytics, advertising networks, tracking pixels, web beacons or social media plugins, and it does not build a profile of You.
Because we set no cookies that require consent, there is no cookie banner.
Server Log Files
When You visit the Website, our hosting provider automatically records information that Your browser transmits. This is technically necessary to deliver the site and to keep it secure. The data includes:
- Your IP address
- the date and time of the request
- the page requested and the amount of data transferred
- the referring URL, where one is sent
- Your browser type, version and operating system
Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest is in delivering the Website reliably, diagnosing faults, and detecting and preventing abuse.
Retention: Log data is retained for a short period for security and diagnostic purposes and is then deleted or anonymized. It is not combined with other data sources, and We do not attempt to identify You from it.
Hosting
The Website is hosted by Netlify, Inc., San Francisco, California, USA, which acts as our processor under a data processing agreement pursuant to Art. 28 GDPR. Netlify processes the server log data described above on our behalf in order to serve the Website to You.
Support Form
Our support page offers a form You can use to contact Us. When You submit it, We process the data You enter:
- Your first and last name
- Your email address
- the type of inquiry You select
- the content of Your message
Submissions are received and stored by Netlify Forms, operated by our hosting provider as our processor. The form includes a hidden anti-spam field, which discards automated submissions; it does not collect information about You.
Legal basis: Art. 6(1)(a) GDPR — the consent You give by ticking the consent box before submitting. Where Your inquiry concerns an existing contract, Art. 6(1)(b) GDPR also applies. You may withdraw Your consent at any time with effect for the future.
Retention: We keep submissions for as long as needed to handle Your request, and thereafter only where statutory retention periods require it.
Contacting Us by Email
If You email Us, We process Your email address, Your message and any information You choose to include, in order to respond.
Legal basis: Art. 6(1)(b) GDPR where Your enquiry relates to a contract, otherwise Art. 6(1)(f) GDPR, our legitimate interest in answering enquiries addressed to Us.
Retention: We keep correspondence for as long as needed to handle Your request, and thereafter only where statutory retention periods require it.
The Games
Game Progress
Our Games store Your progress — such as your level, settings and in-game items — locally on Your device. Where a Game offers cloud saves, that data is synchronized through the platform's own service (for example Apple iCloud or Google Play Games) under that platform's privacy policy.
Crash Reports and Diagnostics
Where a Game reports crashes or technical errors, We may receive diagnostic information such as the device model, operating system version and the technical circumstances of the crash. We use this solely to find and fix defects.
Legal basis: Art. 6(1)(f) GDPR, our legitimate interest in the stability and security of our Games.
Purchases
Purchases of paid content are processed by the platform through which You obtained the Game — the Apple App Store or Google Play. Those platforms act as independent controllers for the payment, and their own privacy policies apply. We do not receive or store Your payment card details.
Third-Party Components in Games
Where an individual Game uses third-party components that process personal data, the categories of data and the recipients are disclosed in that Game's in-app privacy notice and on its store listing.
Recipients of Your Personal Data
We do not sell Your personal data, and We do not share it for third-party advertising.
We disclose personal data only to:
- Processors acting on our instructions under Art. 28 GDPR, currently our hosting provider named above;
- Platforms, where You obtain or purchase a Game through them, acting as independent controllers;
- Public authorities, where We are legally obliged to do so, or where disclosure is necessary to establish, exercise or defend legal claims.
International Transfers
Our hosting provider is established in the United States. Transfers of personal data to it are safeguarded by the Standard Contractual Clauses adopted by the European Commission pursuant to Art. 46(2)(c) GDPR, supplemented by appropriate technical and organizational measures.
You may request a copy of the safeguards We have put in place by writing to the contact address above.
Retention
We retain personal data only for as long as is necessary for the purposes described in this Privacy Policy, or for as long as a statutory retention period requires. When the purpose no longer applies and no retention obligation exists, the data is deleted or anonymized.
Your Rights
Under the GDPR, You have the right to:
- Access (Art. 15) — obtain confirmation of whether We process Your personal data, and a copy of it;
- Rectification (Art. 16) — have inaccurate data corrected and incomplete data completed;

- Data portability (Art. 20) — receive data You provided in a structured, commonly used, machine-readable format;
- Object (Art. 21) — object to processing based on our legitimate interests, as set out below;
- Withdraw consent (Art. 7(3)) — withdraw any consent You have given, at any time, with effect for the future. This does not affect the lawfulness of processing carried out before the withdrawal.

You have the right to object at any time, on grounds relating to Your particular situation, to processing of Your personal data that is based on Art. 6(1)(f) GDPR. Right to Complain
You have the right to lodge a complaint with a supervisory authority, in particular in the Member State of Your habitual residence, place of work or the place of the alleged infringement.

We use appropriate technical and organizational measures to protect Your personal data. The Website is served over an encrypted TLS connection, which You can recognize by the https:// prefix in Your browser's address bar.
Please note that no method of transmission over the internet and no method of electronic storage is completely secure, so We cannot guarantee absolute security.
Children's Privacy
Our Service is not directed at children under 16.
